Wartime Elections Act

The Wartime Elections Act of 1917 gave the vote to female relatives of Canadian soldiers serving overseas in the First World War. It also took the vote away from many Canadians who had immigrated from “enemy” countries. The Act was passed by Prime Minister Robert Borden’s Conservative government in an attempt to gain votes in the 1917 election. It ended up costing the Conservatives support among certain groups for years to come. The Act has a contentious legacy. It granted many women the right to vote, but it also legitimized in law many anti-immigrant sentiments.

McIvor Case

The McIvor v. Canada case was about gender discrimination in section 6 of the 1985 Indian Act, which deals with Indian status. Sharon McIvor — a woman who regained status rights after the passing of Bill C-31 in 1985 — was not able to pass on those rights to her descendants in the same way that a man with status could. In her case against the federal government, the British Columbia Supreme Court ruled in 2007 that section 6 did, in fact, deny McIvor’s equality rights under the Canadian Charter of Rights and Freedoms. In response to this case, the federal government introduced new legislation (Bill C-3) in 2011 to counter gender discrimination in the Indian Act.

Enfranchisement (Plain-Language Summary)

Throughout much of Canadian history, a First Nations person would lose their Indian status if they were enfranchised. An enfranchised person is someone who has the right to vote in elections. A First Nations person who is deemed a Status Indian has certain rights and benefits granted to them through the Indian Act.

Truth and Reconciliation Commission

The Truth and Reconciliation Commission of Canada (TRC) was officially launched in 2008 as part of the Indian Residential Schools Settlement Agreement (IRSSA). Intended to be a process that would guide Canadians through the difficult discovery of the facts behind the residential school system, the TRC was also meant to lay the foundation for lasting reconciliation across Canada.

Truth and Reconciliation Commission (Plain-Language Summary)

The Truth and Reconciliation Commission (TRC) started working in 2008. It was a result of the Indian Residential Schools Settlement Agreement (IRRSA). The IRRSA recognized the suffering and trauma experienced by Indigenous students at residential schools. It also provided financial compensation (money) to the students. The TRC performed many tasks. It created a national research centre. It collected documents from churches and government. It held events where students told their stories. Also, it did research about residential schools and issued a final report. (See also Reconciliation in Canada.)

Highway of Tears

The Highway of Tears refers to a 724 km length of Yellowhead Highway 16 in British Columbia where many women (mostly Indigenous) have disappeared or been found murdered. The Highway of Tears is part of a larger, national crisis of missing and murdered Indigenous women and girls. In 2015, the federal government launched a national inquiry into these cases.

Nobel Prizes and Canada

The Nobel Prizes are awarded annually for achievements that have significantly benefitted humankind. The prizes are among the highest international honours and are awarded in six categories: physics, chemistry, physiology or medicine, literature, peace, and economics. They are administered by the Nobel Foundation and awarded by institutions in Sweden and Norway. Eighteen Canadians have won Nobel Prizes, excluding Canadian-born individuals who gave up their citizenship and members of organizations that have won the peace prize.

The White Paper, 1969

The 1969 White Paper (formally known as the “Statement of the Government of Canada on Indian Policy, 1969”) was a Canadian government policy paper that attempted to abolish previous legal documents relating to Indigenous peoples in Canada, including the Indian Act and  treaties. It also aimed to assimilate all “Indian” peoples under the Canadian state. The 1969 White Paper was proposed by Minister of Indian Affairs and Northern Development  Jean Chrétien and Prime Minister Pierre Elliott Trudeau to widespread criticism. The policy proposed to eliminate Indian Status, incorporate First Nations under provincial government responsibilities, and impose land decisions, notions of private property and economic agendas on Indigenous communities. The backlash to the 1969 White Paper was monumental, leading not only to its withdrawal in 1970, but to a wave of activism, academic work and court decisions over the next five decades. Editorial: Newfoundland’s Contribution to the Patriation of the Constitution

In the decades since 1982, politicians and the media have recounted the same story about the patriation of Canada’s constitution and the adoption of the Charter of Rights and Freedoms. Most of the credit in this version goes to Prime Minister Pierre Trudeau. Three others are credited with breaking an impasse in the 1981 negotiations: federal justice minister Jean Chrétien, Saskatchewan attorney general Roy Romanow, and Ontario attorney general Roy McMurtry. But in his memoirs, former Newfoundland PremierBrian Peckford argues that the key intervention in the patriation process came from Peckford and the members of the Newfoundland delegation.

Missing and Murdered Indigenous Women and Girls in Canada

Missing and murdered Indigenous women and girls in Canada (MMIWG) refers to a human rights crisis that has only recently become a topic of discussion within national media. Indigenous women and communities, women’s groups and international organizations have long called for action into the high and disproportionate rates of violence and the appalling numbers of missing and murdered Indigenous women and girls in Canada. Prior to the launch of the national public inquiry on 8 December 2015, these calls were continually ignored by the federal government. Described by some as a hidden crisis, Dawn Lavell-Harvard, former president of the Native Women’s Association of Canada, refers to MMIWG as a national tragedy and a national shame. In 2015, the Truth and Reconciliation Commission of Canada supported the call for a national public inquiry into the disproportionate victimization of Indigenous women and girls. The National Inquiry’s Final Report was completed and presented to the public on 3 June 2019.

Patriation Reference

The Patriation Reference, formally known as Re: Resolution to Amend the Constitution, was a reference case of the Supreme Court of Canada. On 28 September 1981, the court decided that it was legal for the federal government to patriateand amend Canada’s Constitution without the consent of the provincial governments. But it also found that to do so in areas that affect provincial powers would be a breach of constitutional convention. The court’s decision concluded that such conventions are of great significance. In the words of the court, “Constitutional convention plus constitutional law equal the total constitution of the country.”

Emergencies Act

In July 1988, the War Measures Act was repealed and replaced by the Emergencies Act. The Emergencies Act authorizes “the taking of special temporary measures to ensure safety and security during national emergencies and to amend other Acts in consequence thereof.” In contrast to the sweeping powers and violation of civil liberties authorized by the War Measures Act, the Emergencies Act created more limited and specific powers for the federal government to deal with security emergencies of five different types: national emergencies; public welfare emergencies; public order emergencies; international emergencies; and war emergencies. Under the Act, Cabinet orders and regulations must be reviewed by Parliament, meaning the Cabinet cannot act on its own, unlike under the War Measures Act. The Emergencies Act outlines how people affected by government actions during emergencies are to be compensated. It also notes that government actions are subject to the Canadian Charter of Rights and Freedoms and the Canadian Bill of Rights.

Statute of Westminster, 1931

The Statute of Westminster is a British law that was passed on 11 December 1931. It was Canada’s all-but-final achievement of independence from Britain. It enacted recommendations from the Balfour Report of 1926, which had declared that Britain and its Dominions were constitutionally “equal in status.” The Statute of Westminster gave Canada and the other Commonwealth Dominions legislative equality with Britain. They now had full legal freedom except in areas of their choosing. The Statute also clarified the powers of Canada’s Parliament and those of the other Dominions. Women and the Law

Women have looked to the law as a tool to change their circumstances, while at the same time the law is one of the instruments which confirms their dependent status as citizens (see Status of Women). The first phase of the Women's Movement, in proclaiming that women were capable of reason as well as reproduction and nurturing, claimed a place for women in the public sphere, while also relying upon the concept of "separate spheres" to delineate their areas of strength and competence.

Famous Five

Alberta’s “Famous Five” were petitioners in the groundbreaking Persons Case. The case was brought before the Supreme Court of Canada in 1927. It was decided in 1929 by the Judicial Committee of the Privy Council, Canada’s highest appeals court at the time. The group was led by judge Emily Murphy. It also included  Henrietta EdwardsNellie McClungLouise McKinney and Irene Parlby. Together, the five women had many years of active work in various campaigns for women’s rights dating back to the 1880s and 1890s. They enjoyed a national — and in the case of McClung, an international — reputation among reformers.

Saskatchewan Bill of Rights

The Saskatchewan Bill of Rights came into force on 1 May 1947. Written primarily by lawyer and human rights advocate Morris Shumiatcher, it was enacted by the CCF government led by Premier Tommy Douglas. While critics have debated its efficacy, it remains important because it was Canada’s first bill of rights; it predated the Canadian Bill of Rights (1960), Quebec’s Charter of Human Rights and Freedoms (1975) and the Canadian Charter of Rights and Freedoms (1982).

Editorial: The Canadian Constitution Comes Home

In April 1982, as an Ottawa winter turned to spring, Queen Elizabeth II made her eleventh visit to Canada. She had come to make it official. After more than a half-century of trying, Canada would have its own constitution. A Canadian-made constitution was unfinished business from the country’s colonial past. The British North America Act in 1867 set out the jurisdictions of the federal and provincial governments and created the Dominion of Canada. It was, however, a law of the British Parliament, and it could only be amended (changed) by the British.

Robert Pickton Case

Between 1978 and 2001, at least 65 women disappeared from Vancouver’s Downtown Eastside. Robert Pickton, who operated a pig farm in nearby Port Coquitlam, was charged with murdering 26 of the women. He was convicted on six charges and sentenced to life in prison. In a jail cell conversation with an undercover police officer, Pickton claimed to have murdered 49 women. The murders led to the largest serial killer investigation in Canadian history, and Pickton’s farm became the largest crime scene in Canadian history. The case became a flash point in the wider issue of missing and murdered Indigenous women and girls in Canada. In 2012, a provincial government inquiry into the case concluded that “blatant failures” by police — including inept criminal investigative work, compounded by police and societal prejudice against sex trade workers and Indigenous women ­— led to a “tragedy of epic proportions.”

École Polytechnique Tragedy (Montreal Massacre)

On 6 December 1989, a man entered a mechanical engineering classroom at Montreal’s École Polytechnique armed with a semi-automatic weapon. After separating the women from the men, he opened fire on the women while screaming, “You are all feminists.” Fourteen young women were murdered, and 13 other people were wounded. The shooter then turned the gun on himself. In his suicide note, he blamed feminists for ruining his life. The note contained a list of 19 “radical feminists” who he said would have been killed had he not run out of time. It included the names of well-known women in Quebec, including journalists, television personalities and union leaders.
