Provincial Government in Canada
Under Canada’s federal system, the powers of government are shared between the federal government and 10 provincial governments. The Constitution Act, 1867 granted specific jurisdiction to the provinces in 16 areas, compared to 29 for the federal government. However, provincial powers have expanded since then. Provinces can levy direct taxation and derive most of their non-tax revenue from the use of public lands and natural resources. Provincial governments in Canada are modelled on the British Westminster parliamentary tradition and reflect the principles of responsible government. They comprise an elected legislative assembly, from which a governing cabinet is selected by the premier. The lieutenant-governor assents to legislation as the representative of the Crown.
Newfoundland and Labrador and Confederation
Attempts to bring Newfoundland into Confederation in the 1860s and 1890s were met with lukewarm interest in the colony. In 1934, Newfoundland was in bankruptcy during the Great Depression. It suspended responsible government and accepted an unelected Commission Government directed by Britain. In a 1948 referendum, Newfoundlanders were given the choice to either continue with the Commission Government, join Canada, or seek a return to responsible government as an independent dominion. The independence option won the first vote. But the Confederation option won a run-off vote with 52.3 per cent support. The British and Canadian parliaments approved of the union. Newfoundland became Canada’s 10th province on 31 March 1949. In 2001, the province’s name was officially changed to Newfoundland and Labrador.
Editorial: Baldwin, LaFontaine and Responsible Government
The Baldwin–LaFontaine government of 1848 has been called the “great ministry.” In addition to establishing responsible government, it had an incomparable record of legislation. It established a public school system and finalized the founding of the University of Toronto. It set up municipal governments and pacified French-Canadian nationalism after a period of unrest. Responsible government did not transform Canada overnight into a fully developed democracy. But it was an important milestone along the road to political autonomy. Most importantly, it provided an opportunity for French Canadians to find a means for their survival through the British Constitution. The partnership and friendship between Baldwin and LaFontaine were brilliant examples of collaboration that have been all too rare in Canadian history.
Rep by Pop
Representation by population is a political system in which seats in a legislature are allocated on the basis of population. It upholds a basic principle of parliamentary democracy that all votes should be counted equally. Representation by population was a deeply divisive issue among politicians in the Province of Canada (1841–67). Nicknamed “rep by pop,” it became an important consideration in the lead up to Confederation. (See also: Representative Government; Responsible Government.)
Act of Union
The Act of Union was passed by the British Parliament in July 1840. It was proclaimed on 10 February 1841 in Montreal. It created the Province of Canada by uniting the colonies of Canada West (formerly Upper Canada) and Canada East (formerly Lower Canada) into one government. Reform Movement in Upper Canada
After the War of 1812, Upper Canada began to develop rapidly. This resulted in social and economic tensions and political issues. These included the expulsion of Robert Gourlay, the Alien Question, the Anglican monopoly of the Clergy Reserves and education, and Tory control of patronage.
British Columbia and Confederation
The colony of British Columbia was founded in 1858 in response to the Fraser River Gold Rush. (See also The Fraser River Gold Rush and the Founding of British Columbia.) The colony established representative government in 1864 and merged with the colony of Vancouver Island in 1866. In May 1868, Amor De Cosmos formed the Confederation League to bring responsible government to BC and to join Confederation. In September 1868, the Confederation League passed 37 resolutions outlining the terms for a union with the Dominion of Canada. The terms were passed by both the BC assembly and the federal Parliament in 1871. The colony joined Canada as the country’s sixth province on 20 July 1871. The threat of American annexation, embodied by the Alaska purchase of 1867, and the promise of a railway linking BC to the rest of Canada, were decisive factors.
In a monarchy, the Crown is an abstract concept or symbol that represents the state and its government. In a constitutional monarchy such as Canada, the Crown is the source of non-partisan sovereign authority. It is part of the legislative, executive and judicial powers that govern the country. Under Canada’s system of responsible government, the Crown performs each of these functions on the binding advice, or through the actions of, members of Parliament, ministers or judges. As the embodiment of the Crown, the monarch — currently Queen Elizabeth II — serves as head of state. The Queen and her vice-regal representatives — the governor general at the federal level and lieutenant-governors provincially — possess what are known as prerogative powers; they can be made without the approval of another branch of government, though they are rarely used. The Queen and her representatives also fulfill ceremonial functions as Head of State.
The federal government is the national government of Canada, centred in Ottawa. The term can refer narrowly to the Canadian Cabinet, or more broadly to the Cabinet and the public service.
Great Coalition of 1864
The politics of the Province of Canada in the early 1860s were marked by instability and deadlock. The Great Coalition of 1864 proved to be a turning point in Canadian history. It proved remarkably successful in breaking the logjam of central Canadian politics and in helping to create a new country. The coalition united Reformers and Conservatives in the cause of constitutional reform. It paved the way for the Charlottetown Conference and Confederation.
In 1841, Britain united the colonies of Upper and Lower Canada into the Province of Canada. This was in response to the violent rebellions of 1837–38. The Durham Report (1839) laid out the guidelines to create the new colony with the Act of Union in 1840. The Province of Canada was made up of Canada West (formerly Upper Canada) and Canada East (formerly Lower Canada). The two regions were governed jointly until Confederation in 1867. Canada West then became Ontario and Canada East became Quebec.
Administrative Tribunals in Canada
Administrative tribunals make decisions on behalf of federal and provincial governments when it is impractical or inappropriate for the government to do so itself. Tribunals are set up by federal or provincial legislation; this is known as “empowering legislation.” Tribunals are commonly known as commissions or boards. They make decisions about a wide variety of issues, including disputes between people or between people and the government. Tribunals may also perform regulatory or licensing functions. Their decisions may be reviewed by the courts. Because they engage in fact-finding and have the power to impact personal rights, tribunals are often seen as “quasi-judicial.”
Responsible government refers to a government that is responsible to the people. In Canada, responsible government is an executive or Cabinet that depends on the support of an elected assembly, rather than a monarch or their representatives. A responsible government first appeared in Canada in the 1830s. It became an important part of Confederation. It is the method by which Canada achieved independence from Britain without revolution.
Political Campaigning in Canada
A political campaign is an organized effort to secure the nomination and election of people seeking public office. In a representative democracy, electoral campaigns are the primary means by which voters are informed of a political party’s policy or a candidate’s views. The conduct of campaigns in Canada has evolved gradually over nearly two centuries. It has adapted mostly British and American campaign practices to the needs of a parliamentary federation with two official languages. Campaigns occur at the federal, provincial, territorial and municipal levels. Federal and provincial campaigns are party contests in which candidates represent political parties. Municipal campaigns — and those of Northwest Territories and Nunavut — are contested by individuals, not by parties.
Municipal Government in Canada
Municipal governments are local elected authorities. They include cities, towns and villages, and rural (county) or metropolitan municipalities. They are created by the provinces and territories to provide services that are best managed under local control; from waste disposal and public transit to fire services, policing, community centres and libraries. A municipal government’s revenue is raised largely from property taxes and provincial grants.
Elections are a process in which Canadian citizens express their preferences about who will represent and govern them. Those preferences are combined to decide which candidates will become Members of Parliament. Elections are fundamental to the operation of democracy in Canada as they are the central means by which citizens grant authority to those who govern them.
In 1838, the British politician Lord Durham was sent to British North America to investigate the causes of the rebellions of 1837–38 in the colonies of Upper and Lower Canada. Durham's famous Report on the Affairs of British North America (1839) led to a series of reforms and changes. These included uniting the two Canadas into a single colony, the Province of Canada, in 1841. (See also: Act of Union.) The report also paved the way for responsible government. This was a critical step in the development of Canadian democracy. The report played an important role in the evolution of Canada’s political independence from Britain.
Rebellion in Upper Canada
The 1837 rebellion in Upper Canada was a less violent, more limited affair than the uprising earlier that year in Lower Canada. However, its leaders, including William Lyon Mackenzie, were equally serious in their demands. They wanted democratic reform and an end to the rule of a privileged oligarchy. The rebellion itself failed, but its very failure helped pave the way for moderate and careful political change in British North America. This included the union of Upper and Lower Canada into the Province of Canada and the eventual introduction of responsible government.
Lobbying in Canada
Lobbying is the process through which individuals and groups articulate their interests to federal, provincial or municipal governments to influence public policy or government decision-making. Lobbyists may be paid third parties who communicate on behalf of their clients; or they may be employees of a corporation or organization seeking to influence the government. Because of the possibility for conflict of interest, lobbying is the subject of much public scrutiny. At the federal level, lobbying activities are governed by the Lobbying Act. Provinces and municipalities have their own lobbying laws and by-laws.
